1. Who we are and when these terms apply
These Terms and Conditions apply to every purchase of digital products from Comfort Film Academy on comfort-academy.com and its checkout pages.
Comfort Film Academy is a brand of:
Comfort Film GmbH Friedrichstrasse 95, 10117 Berlin, Germany Managing director: Felix Schönewald Commercial register: Berlin HRB 164597 B VAT ID: DE301226637 Email: [email protected]
("we", "us"). "You" means the person or company buying from us.
1.1 These terms apply to consumers and to businesses. A consumer is anyone who buys mainly for purposes outside their trade, business or profession. Where a clause applies only to consumers or only to businesses, it says so.
1.2 Your own terms do not apply, even if we do not object to them, unless we agree to them in writing.
1.3 The contract language is English.
2. Our products
2.1 We sell digital products for independent filmmakers and creatives: spreadsheet tools (Microsoft Excel files that also work in Google Sheets, no macros), PDF guides and worksheets, and Word templates. Some products are free, for example the Profit Calculator DEMO. These terms apply to free products too, except for the payment clauses.
2.2 The product page and the checkout show each product's contents, file formats and price. The description shown when you place your order is what you buy.
2.3 To use the files you need a device and software that opens these formats, for example Google Sheets (free, in the browser), Microsoft Excel, a PDF reader and a word processor for .docx files. We do not supply this software. Layout and some functions may differ in other apps (such as Apple Numbers) and on small screens.
3. How your order works
3.1 Our product pages are not a binding offer. They invite you to place an order.
3.2 In the checkout you enter your details and choose a payment method. You can add an optional extra product shown there. Before you order, you see a summary of the products and the total price, and you can correct your entries in the form fields.
3.3 When you click the order button ("Buy now" or a similar button that states you are ordering with an obligation to pay), you place a binding order. The contract is formed when we confirm your order on the confirmation page or by email, or when we give you access to the files, whichever comes first.
3.4 After checkout we may offer you an upgrade on a separate page, for example START PLUS. This is a separate contract. It is formed only if you click the order button on that page, which shows the price. We charge the payment method you used for your first order.
3.5 We send you an order confirmation by email with the order details, these terms and the cancellation information. We also store the contract details. These terms are always available at [URL of this page].
4. Prices, VAT and payment
4.1 Prices are shown in the checkout in the currency stated there. For consumers, prices include VAT or sales tax where it applies. The tax depends on where you are and is shown before you order.
4.2 If you buy as a business and enter a valid VAT ID from another EU country, the reverse-charge procedure may apply. You then pay the price without VAT.
4.3 Payments are processed by our payment provider Stripe. You can use the payment methods offered in the checkout. The price is due when you place your order.
4.4 You receive a receipt or invoice from Comfort Film GmbH by email.
4.5 All products are one-time purchases. There is no subscription and no automatic renewal unless a product page clearly says otherwise.
5. Delivery and access
5.1 You get the files right after payment, as a download link in your confirmation email or in your online account, as stated in the checkout.
5.2 Please download and save the files straight away. Download links and account access stay available for at least [12] months after your purchase.
5.3 If you have not received an email within one hour, check your spam folder and then write to [email protected].
5.4 If a payment is reversed or charged back without a valid reason, we may block access until the payment is settled.
6. Cancellation policy for consumers
If you are a consumer, you have the following right of withdrawal. Businesses have no right of withdrawal.
Right of withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period expires 30 days after the day the contract is concluded.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement, for example by letter or email, to: Comfort Film GmbH, [Street and number], [Postcode] Berlin, Germany, [email protected]. You may use the model withdrawal form below, but you do not have to.
You can also withdraw online with the "Withdraw from contract" function on our website at [URL]. If you use it, we will confirm receipt of your withdrawal by email without delay.
To meet the withdrawal deadline, it is enough that you send your notice before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we will refund all payments we received from you without undue delay, and no later than 14 days after the day we receive your notice of withdrawal. We will use the same payment method you used for the original transaction, unless we expressly agree otherwise with you. You will not be charged any fees for this refund.
Early expiry for digital content
Your right of withdrawal expires early once we start providing the digital content (download link or access to the files), if:
you have expressly agreed that we start before the end of the withdrawal period,
you have confirmed that you know you lose your right of withdrawal once we start, and
we have confirmed the contract to you on a durable medium, for example by email, including your consent.
In the checkout we ask for this consent with a separate checkbox. Your statutory rights if a product is defective (clause 10) are not affected.
Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)

7. Licence: what you may do with the files
7.1 All products are protected by copyright. All rights stay with Comfort Film GmbH unless this clause grants them to you.
7.2 Once you have paid in full, you receive a non-exclusive, non-transferable, worldwide and permanent licence for one person to use the files in your own work, including paid client projects.
7.3 You may:
save the files on your devices and in your own cloud storage (for example Google Drive) and make backup copies,
adapt the templates to your business,
send the documents you create with them, such as quotes, invoices, contracts, releases and pitch decks, to your clients. These finished documents are yours.
7.4 You may not:
sell, share, give away, sublicense or publish the files or parts of them, including in template shops, marketplaces, courses or file-sharing groups,
pass on your download links or account access,
use the files to build a competing product,
remove copyright notices from the tools and guides.
7.5 One licence covers one user. For several users in one company, buy one licence per user or contact us for a team licence.
7.6 If you breach clause 7.4, we may end your licence and block your access. Our other rights remain.
8. Tools and templates, not professional advice
8.1 Our products give you practical tools and general information. They are not legal, tax, financial or accounting advice and do not replace a lawyer, tax adviser or accountant.
8.2 Contract, release and form templates, for example in the Legal START Kit, are general samples. They have not been reviewed for your country or your project. Laws differ from country to country, especially on image rights, minors on set, usage rights, invoices and VAT. Have templates checked by a qualified local adviser before you rely on them.
8.3 The calculators work with the figures you enter. Sample values are examples, not market rates or recommendations. You are responsible for your own prices, quotes, invoices and tax filings, including the mandatory invoice details in your country.
9. No guarantee of results
Our claim "Keep creating. Make a living." describes what our tools are built to help you with. We do not promise any income, number of clients, price level or other business result. Examples, case studies and figures in our materials are illustrations. Your results depend on your skills, your market, your effort and other factors outside our control.
10. If something does not work
10.1 Your statutory rights for defects apply. If a product does not work as described, write to [email protected]. We will fix the problem or send you a corrected version. If we cannot, you have the statutory rights, such as a price reduction or ending the contract, and damages under clause 11.
10.2 If you are a consumer, we provide the updates needed to keep the product working as described for the period required by law, and we tell you about them by email. We do not owe new features or new versions.
10.3 If you are a business, claims for defects expire one year after delivery. This does not apply to claims under clause 11.1.
11. Liability
11.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
11.2 For slight negligence we are liable only if we breach an essential contractual obligation. That is an obligation that makes proper performance of the contract possible in the first place and on which you may regularly rely. Our liability is then limited to the damage that is typical for this kind of contract and foreseeable when it was made.
11.3 For free products, such as the Profit Calculator DEMO, we are liable only for intent and gross negligence and in the cases listed in clause 11.1.
11.4 Please check your own calculations, quotes and invoices before you send them and back up your files regularly. For lost data, we are liable only for the effort it would have taken to restore it from a regular backup.
11.5 These limits also apply to our employees, representatives and agents.
11.6 Nothing in these terms limits rights that you have as a consumer under the mandatory law of the country where you live.
12. Privacy
We process your personal data as described in our Privacy Policy at: DSGVO – Comfort Film GmbH. Our checkout platform Course IQ and our payment provider Stripe process data needed to handle your order.
13. Applicable law and disputes
13.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not take away the protection of the mandatory laws of the country where you live.
13.2 If you are a merchant, a legal entity under public law, or have no general place of jurisdiction in Germany, the courts of Berlin, Germany, have exclusive jurisdiction.
13.3 If you have a complaint, please write to [email protected] first. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
14.1 We may update these terms for future orders. Your order is governed by the version shown when you placed it.
14.2 If a clause of these terms is invalid, the rest of the terms remain valid.
